The appellant obtained a jurys verdict in the court below for damages for personal injuries suffered by him though the alleged negligence of the defendant company in the operation of its railroad. On a question of law reserved, the court entered judgment for the defendant n.o.v. on the ground that the plaintiff was guilty of contributory negligence as a matter of law. From that judgment the plaintiff has appealed.
